LEGAL BRIEF: NFLPA Drops Appeal on Madden Suit

The lawsuit between the retired players has been settled out of court with the NFL Player’s Association Electronic Arts, agreeing not to appeal the $28.1M compensation awarded the retired players in November for their appearance in Madden NFL games without being paid.
The settlement will net players about $10,000 apiece after lawyers’ fees, half this year and the other half within two years.
“They got a 10 percent discount and we got our money now,” said Ronald S. Katz, the lead lawyer for the players. “A lot of them are elderly and a lot of them are ill, and for them to get this money is very substantial. To have the full amount years from now would not mean anything.”
NFL Hall of Famer Herb Adderley was the named plantiff in the suit, alleging that the NFLPA advised Madden publisher Electronic Arts to “scramble” the players’ likenesses (numbers, heights, sometimes races, but not stats) in order to use them in historic team rosters without compensation. Electronic Arts may be the next target for a lawsuit.
