LEGAL BRIEF: What a Duke-Tastrophe

So is Duke on or off?
Ever since the news that Duke Nukem Forever was finally euthanized people have been wondering what happened to all the work that went into the property. GamePolitics.com did some digging into the lawsuit between Apogee and Take-Two and found an interesting tid-bit.
Apparently the $2.5 million advance that Take-Two paid Apogee was to come either from royalties off DNF OR – get this – A DIFFERENT DUKE GAME being made by another developer. Apparently 2K Games, the folks who brought us Bioshock, had been working on “Duke Begins“, which may itself have been put out to pasture this past April.
Apogee wasn’t exactly thrilled with finding out that a subsidiary work which would have paid them royalties was cancelled and when they confronted Take-Two and 2K games about it what ensued was the typical “Uh-huh!” “Nuh-uh!” back and forth argument.
So will we actually be seeing anything approximating a Duke Nukem game any time soon? Apogee, the owner of the property, is under the assumption that Take-Two is trying to tank the property intentionally so they can pick it up for a song, but that begs the question “How do you tank a property that has been in development hell for TWELVE YEARS?”
There are kids starting middle school this year who were born the year DNF was announced.
